General Terms and Conditions

These General Contracting Conditions govern the commercial relationship between IPC Automotive Technology Europe S.L.U. (AUTOMOTIVEB2B) and the user or customer for contracting carried out through the forms available at www.automotiveb2b.com. Contracting through the websites implies express acceptance of these conditions and of the terms of use for browsing.

These conditions apply without prejudice to the legal regulations in force, including Spanish Law 7/1998, of 13 April, on General Contracting Conditions; Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users; Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD) on data protection; Law 7/1996, of 15 January, on Retail Trade Regulation; and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce.

AUTOMOTIVEB2B reserves the right to make changes to the General Conditions without prior notice, and they are binding for as long as they are published on the website. In certain cases, Particular Contracting Conditions will apply with preference over these General Conditions.

Pre-Contractual Information

The user expressly declares that they know, understand and accept these terms of use and general contracting conditions. The user must be of legal age and have the legal capacity to access the websites and enter into contracts.

The user is responsible for treating their identity and password confidentially and responsibly, and may not transfer them to another person. After making the purchase, you will receive an email with the order confirmation, which you can print as proof. The order confirmation and proof of purchase are not valid as an invoice.

To request an invoice, you must send your request to info@automotiveb2b.com, indicating the order number, full name and ID number.

How the Purchase Works

1. Product offer and price reference

AUTOMOTIVEB2B provides information on all products on sale, their characteristics and prices. It reserves the right to withdraw, replace or change the products offered by changing the content of its web pages. The products are governed by the General Conditions in force in each case. The company may stop offering access to the aforementioned products without prior notice and at any time.

2. Indication of prices

Each product will display its price and VAT or other applicable taxes. If the price is not specified, there is an option to enquire about it by sending a request. All prices are expressed in Euros.

AUTOMOTIVEB2B reserves the right to modify its prices at any time, but products are invoiced on the basis of the rates in force at the time the order is placed.

3. Shipping costs

Shipping costs vary depending on weight, dimensions, distance and type of carrier, among other factors.

4. Availability

Product availability may vary depending on demand. Although AUTOMOTIVEB2B updates its stock periodically, the requested product may be out of stock. In that case, an email will be sent to the customer informing them of the impossibility of fulfilling the order or the estimated availability date.

5. Order delivery

Delivery is carried out through professional courier companies. AUTOMOTIVEB2B works with first-class logistics operators such as GLS, DSV and FedEx, as well as other carriers depending on the destination and type of shipment. AUTOMOTIVEB2B reserves the right to change the shipping company provided this does not cause obvious harm to the customer.

6. Payment methods

AUTOMOTIVEB2B offers the following payment methods: bank transfer, PayPal, PayPal cards, VISA and MASTERCARD. For questions about payment methods not mentioned, please contact us by email at info@automotiveb2b.com.

7. Returns policy

AUTOMOTIVEB2B complies with current regulations. If you are not satisfied with your order, you have a period of 14 calendar days from the delivery date to exercise the right of withdrawal, in accordance with Articles 102 et seq. of Royal Legislative Decree 1/2007.

The product must be returned in perfect condition and in its original packaging, including warranties, labels and instructions for use. It is important to return the products perfectly packaged. If they are damaged due to inappropriate packaging, the return will not be accepted.

Returns are not accepted after 14 days from the delivery date of the package. Any claim must be notified within 24 hours of receipt of the package. In the event of a return, contact us at info@automotiveb2b.com, indicating the subject “Return…” and your name, together with an explanation of the case. You will receive an email with instructions and/or authorisation for the return. All return shipping costs are borne by the buyer.

Data protection

In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD), AUTOMOTIVEB2B informs you that the personal data collected is provided freely and voluntarily. This data will be processed under the responsibility of AUTOMOTIVEB2B.

AUTOMOTIVEB2B informs you that the legal basis is the unequivocal consent given when providing the personal data, for the purpose of providing the requested service and sending commercial communications, including by electronic means, about activities, news, web product publications and offers of AUTOMOTIVEB2B and/or of third parties related to the automotive sector.

The user must guarantee that all information provided is truthful and complete. Failure to complete all the requested data could prevent AUTOMOTIVEB2B from properly handling your request.

AUTOMOTIVEB2B undertakes to comply with its obligation of secrecy regarding personal data and its duty to treat it confidentially, adopting technical, organisational and security measures to prevent its alteration, loss, unauthorised processing or access, in accordance with the GDPR, the LOPDGDD and other applicable legislation.

Consent to receive commercial communications by electronic means may be revoked at any time, without retroactive effect, through the mechanism provided in each communication or by sending an email to info@automotiveb2b.com with the subject “Unsubscribe request”.

The rights of access, rectification, erasure, objection, restriction of processing and portability may be exercised by writing to IPC Automotive Technology Europe S.L.U., with Tax ID B98723786 and registered office at Camí Vell de Xátiva 29-C (Pol. Ind. Sant Vicent), 46870 Onteniente, Valencia, Spain. The request must include name and surname, a document proving identity and the content of the right exercised. A complaint may also be filed with the Spanish Data Protection Agency (www.aepd.es).

AUTOMOTIVEB2B will delete or block the user’s data when it proves inaccurate, incomplete or no longer necessary or relevant for its purpose, in accordance with data protection legislation.

Applicable law and jurisdiction

The relationship between the user and AUTOMOTIVEB2B shall be governed by the regulations in force and applicable in the territory of Valencia. The courts with jurisdiction to decide on disputes are those of the territory of Valencia.

Acceptance of these general conditions of sale governs the contractual relationship between AUTOMOTIVEB2B and its customer, both parties accepting them without reservation. These General Conditions are governed by Spanish law. For the resolution of disputes, and waiving any other jurisdiction, the parties submit to the courts and tribunals of the user’s domicile.
